This policy explains what personal data ActiveMantra Health & Wellness LLP (LLPIN ACV-0190), trading as DancewithDeepti ("DWD", "we", "us"), collects about you, why, who we share it with, how long we keep it, and the rights you have. We are the data fiduciary for your personal data under the Digital Personal Data Protection Act, 2023.

2. What this policy covers
- 2.1This policy applies to personal data we collect through our website, member area, live classes, WhatsApp and email, payment checkout, and our Personalised Nutrition Plan service.
- 2.2It does not cover third-party services such as Zoom, YouTube, Instagram or payment gateways, which have their own privacy policies. See section 9.
- 2.3This policy forms part of our Terms & Conditions, and covers any new programme, plan or offer we launch.
- 2.4If a new service needs a type of personal data not described here, we will tell you what it is and why we need it before we collect it, and update this policy.

4. Why we use it
We use your personal data only for these purposes:
- Running your membership: creating your account, giving you access to classes and the member area, managing pauses, and confirming purchases.
- Keeping you safe: understanding health conditions or injuries so Trainers can suggest modifications, and checking eligibility (for example age and pregnancy).
- Personalised Nutrition Plans: preparing your plan, if you buy one.
- Payments and accounts: processing payments, refunds and GST invoices, and keeping the financial records the law requires.
- Communicating with you: the messages described in section 10.
- Improving our classes: training our Trainers and checking class quality, including through recordings (section 7).
- Protecting our service: preventing shared logins, fraud and misuse, and enforcing our Terms.
- Meeting legal obligations: responding to lawful requests from authorities and resolving disputes.
We do not use your data for automated decisions that significantly affect you, and we do not sell or rent it to anyone.
5. Your consent
- 5.1We process your personal data on the basis of your consent, which you give when you register, buy a pass or Personalised Nutrition Plan, or share information with us, after being shown this policy. We also process data without consent where the law allows, for example to keep tax records or to respond to a medical emergency.
- 5.2You can withdraw your consent at any time by writing to support@dancewithdeepti.com. Withdrawing is as easy as giving consent. Once you withdraw, we will stop processing the data concerned, except where the law requires us to keep it.
- 5.3Some data is essential to provide the service. For example, we cannot safely run classes for you without basic health information. If you withdraw consent for essential data, we may have to end your access. The refund rules in our Refund & Cancellation Policy then apply.
6. Health information
- 6.1Health information from your registration form is seen only by the DWD team members and Trainers who need it to guide your participation safely.
- 6.2Nutrition intake information and medical reports for a Personalised Nutrition Plan are shared only with the dietitian preparing your plan, and with DWD staff who arrange your consultation.
- 6.3We never use your health information for marketing, and never share it with insurers, employers or advertisers.
- 6.4In a medical emergency during a class, we may share relevant information with emergency services or your emergency contact.
7. Class recordings
- 7.1We record some live sessions only for internal Trainer training and quality assurance. Zoom shows an on-screen notice to everyone while recording is on.
- 7.2If you keep your camera or microphone on while the recording notice is showing, your image, voice and display name will be captured. If you do not want to appear, keep your camera and microphone off. You can still take the class.
- 7.3Recordings are viewed only by the DWD team and are deleted within 60 days. They are never used for marketing without your separate written consent.
- 7.4You can ask us to delete any recording you appear in by writing to support@dancewithdeepti.com.
8. Under 18s and children
- 8.1Our services are for adults, and everyone who signs up confirms they are 18 or older. Where we accept someone aged 13 to 17 on a case-by-case basis, we do so only with verifiable consent from their parent or legal guardian, which we record. The parent can exercise the young person's rights under section 14.
- 8.2For anyone under 18, we do not track behaviour across the internet, show targeted advertising, or send promotional messages to them directly.
- 8.3We do not register anyone under 13. If a Member's child occasionally joins a class on the Member's screen, we do not collect the child's personal data. The parent decides whether the child appears on camera while a recording notice is showing.
- 8.4If we learn that we have collected data from a child without proper parental consent, we will delete it.
9. Who we share it with
We share personal data only with the following, and only as much as each needs:

- 9.1Our service providers process your data only on our instructions and for the purposes above, and must keep it secure.
- 9.2Some providers, such as Zoom and Google, may store or process data outside India. We transfer data abroad only as permitted under Indian law.
- 9.3If our business is sold or merged, your data may pass to the new owner, who must continue to protect it under this policy.
10. Messages we send
We contact you by email, WhatsApp, SMS or in-app notification only for:
- Service messages: purchase and booking confirmations, schedule changes, and pause or account updates;
- One-off reminders: for example if you have missed classes, or when your pass is about to expire; and
- Occasional invitations to return: after your pass has ended, we may send a broadcast message about current batches or offers.
We do not send mass promotional messages or make promotional phone calls. You can stop reminders and invitations at any time by replying STOP on WhatsApp or writing to support@dancewithdeepti.com. We will act on it within 48 hours. Any marketing emails we send will include an unsubscribe link. Service messages about an active pass will continue.
11. How long we keep it

If you ask us to delete your data, or withdraw consent, we will delete it sooner, except records we must keep by law. Before deleting an inactive account, we will give you at least 48 hours' notice so you can choose to keep it.
12. How we protect it
- 12.1We use reasonable security measures, including password-protected and access-controlled systems, limiting health information to staff who need it, and choosing reputable service providers.
- 12.2No system is completely secure. If a personal data breach affects you, we will tell you and the Data Protection Board of India as the law requires, explain what happened, and tell you what we are doing about it.
- 12.3Keep your login details and class links private. Sharing them puts your data, and other Members' privacy, at risk.
13. Cookies
- 13.1Our website uses essential cookies to keep you logged in and make checkout work. These cannot be switched off.
- 13.2We may also use analytics cookies to understand how visitors use our website, so we can improve it. You can block or delete these through your browser settings without affecting your access to classes. If you visit from the UK or Europe, we ask for your consent before setting analytics cookies.
14. Your rights
Under the Digital Personal Data Protection Act, 2023, you have the right to:
- Know what personal data we hold about you, how we use it, and who we have shared it with;
- Correct inaccurate or incomplete data, and update it;
- Delete your data, except where the law requires us to keep it;
- Withdraw consent at any time (see section 5);
- Raise a grievance with us and have it resolved (see section 17); and
- Nominate someone to exercise these rights on your behalf if you die or become unable to.
To exercise any of these rights, write to support@dancewithdeepti.com from your registered email address. We may need to verify your identity first. We will respond within 30 days.
You also have a duty to give us accurate information and not to make false or frivolous complaints.
15. Members in the UK and Europe
If you live in the United Kingdom, the European Union or the wider European Economic Area, data protection law where you live (the UK GDPR or the EU GDPR) also applies to how we handle your personal data. This section explains what that means for you, in addition to the rest of this policy.
- 15.1Why we are allowed to use your data. We use your data:
- to provide the services you buy: your account, classes, pauses and payments;
- with your explicit consent for health information and nutrition intake, which you give when you complete our health form or intake questionnaire;
- to meet legal obligations, such as keeping tax and accounting records; and
- for our legitimate interests in training our Trainers, checking class quality, and preventing misuse such as shared logins. We balance these against your rights, and you can object at any time.
- 15.2Your extra rights. As well as the rights in section 14, you can ask us to restrict how we use your data, object to our using it for our legitimate interests or to send you reminders and invitations, and receive a copy of the data you gave us in a commonly used format so you can move it to another provider. We will respond within one month.
- 15.3Where your data goes. We are based in India, so your data is transferred to and stored in India, and may be processed by our service providers in other countries (see section 9). We transfer it because it is necessary to provide the services you have asked for, and where our providers offer them, we rely on recognised safeguards such as standard contractual clauses. You can ask us for more information about these safeguards.
- 15.4Complaints. You can complain to our grievance officer (section 17). You also have the right to complain to the data protection authority where you live: in the UK, the Information Commissioner's Office (ico.org.uk); in the EU or EEA, the data protection authority of your country.
16. Changes to this policy
We may update this policy from time to time. The latest version is always on our website with its "Last updated" date. For material changes, we will notify you by email, WhatsApp or in the member area at least 15 days before they take effect.
